Despite the fact that this may be the first time you've ever seen <a href="http://www.joystiq.com/tag/nintendo">Nintendo</a> mentioned on Massively, it may not be the last. According to an article at Gamespot, the <a href="http://en.wikipedia.org/wiki/Nintendo">121-year-old Japanese console company</a> has patented the term "massively single-player" to define a new genre of games that they hope to create.<br />
<br />
The basic idea is that you would play a single-player game, and (through an internet connection) what you do in that game would influence the environment or economy of the same game on someone else's console. Nintendo gives several examples of how this would work, including the construction of housing in a neighborhood, oil supply and demand, and even gossip, without those pesky "other players" messing up your game. The patent mentions the fact that people who share the same friends list may be able to see each other (much like <em>Fable III</em> does), but other than that, it's not so much the other players you see, but only their effects on the game's world.<br />

Now, 16 months after it began, the matter is settled -- literally.<br />

<a href="http://www.virtualworldsnews.com/2010/04/worldscom-settles-ncsoft-suit-short-on-funds.html">Virtual Worlds News reported this morning</a> that the lawsuit has been dismissed due to a settlement between the two parties. The terms of the settlement are confidential as are the reasons behind it, but it may well be that <a href="http://www.worlds.com/">Worlds.com</a> president and sole full-time employee Thomas Kidrin has simply exhausted his resources. Kidrin was recently quoted as saying <em>"if we do not develop any new projects, we would have to severely diminish our operations or halt them entirely," </em>so going toe-to-toe with <a href="http://www.plaync.com">NCsoft</a> was a pretty ambitious project.<br />

Fahy alleges that an algorithm in one of his <em><a href="http://secondlife.com/"><em>Second Life</em></a> </em>products has been subjected to copyright infringement, accompanied by the usual requests for damages, statutory damages, <em>ten times damages</em>, attorney's fees and all that.</p>

<p>Article One Partners, "a global community that rewards members for discovering patent validity evidence to legitimize US patents", has <a href="http://www.articleonepartners.com/winnerDetails.php?id=32" rel="nofollow">announced that they have turned up prior-art</a> that <em>may</em> (or may not) be useful in overturning the <a href="http://massively.joystiq.com/tag/worlds.com-vs-ncsoft/">Worlds.com US Patent 7,181,690</a>.</p>
<p>It's difficult to judge on its merits. Article One receives revenue by on-selling that information to interested parties. It isn't often that we get  to cover the <em>end</em> of a lawsuit -- they generally tend to drag on  somewhat -- but it's possible that this might not be quite over.</p>
<p>Linden Lab hadn't yet filed a response to the original complaint, the suit  can be dropped 'without prejudice'. That means the suit can be filed again.</p>
<p>Perhaps Taser International has found some far more interesting or lucrative  basis for a case. It is also possible that the changes to <em></em><a href="http://secondlife.com/"><em>Second Life</em></a> products that now assert  the primacy of the TASER trademark have satisfied the company. Or perhaps, at  the end of the day, the whole effort met some unknown marketing targets. This  could all be on again. Watch this space.</p>

Dannenberg</a> has reported on his website, <a href="http://www.patentarcade.com/2009/04/case-update-worldscom-v-ncsoft.html">Patent Arcade</a>, that the patent dispute between Worlds.com and NCSoft will be moved from the Eastern Texas district to the Northern California district as of 4th May 2009. <a href="http://worlds.com">Worlds.com</a> is persuing <a href="http://www.ncsoft.com">NCSoft</a> over <a href="http://massively.joystiq.com/2008/12/29/worlds-com-files-suit-against-ncsoft-for-patent-infringement/">alleged infringements of patents</a> that it owns.<br /><br />The eastern Texas district has acquired a reputation for being the ideal court for this kind of patent due to favorable attitudes to plaintiffs, resulting in a practice known as <a href="http://en.wikipedia.org/wiki/Forum_shopping">forum shopping</a> being used to maximize the chance of a successful outcome. On December 5th 2008 the Texas Supreme Court <a href="http://www.supreme.courts.state.tx.us/historical/2008/dec/070195.htm">issued a ruling</a> that severely limits the discretion available to a trial court to determine if a case should be dismissed if an adequate alternate forum exists. We got a hold of the April 17 complaint yesterday, and have been going through it since then. We've got a summary of the complaint and issues for you, but we won't be linking to the complaint due to the presence of what may be considered to be pornographic images in Exhibit 2. The "crack den" reference in the headline is a recurring phrase in the legal complaint. You'll see why.</p>

<p>It doesn't end there, however. Worlds.com CEO <a href="http://www.businessinsider.com/worldscom-ceo-were-absolutely-going-to-sue-second-life-and-world-of-warcraft-2009-3">Thom Kidrin has told Eric Krangel at Business Insider</a> that if the suit against NCsoft succeeds, industry leaders <em><a target="_blank" href="http://worldofwarcraft.com/">World of Warcraft</a></em> and <a href="http://secondlife.com/"><em>Second Life</em></a> are next. <p>There are essentially only two ways in which the notice can be legally served to NCsoft in the Republic of Korea to establish jurisdiction over NCsoft as a defendant. One is through formal diplomatic channels, and the other is via the <a href="http://en.wikipedia.org/wiki/Hague_Service_Convention">Hague Service Convention</a>. The HSC was established because of the enormous delays in using the formal diplomatic channels. However, the company does look to be preparing a defense, according to <a href="http://www.virtualworldsnews.com/2008/12/ncsoft-to-defend-itself-vigorously-against-worldscom.html">Virtual Worlds News</a>.<br /><br />"We can't comment on potential litigation except to say that NCsoft takes all legal action seriously -- even if the company believes a lawsuit has no merit," an NCsoft representative told Virtual Worlds News. We talked about those patents and <a href="http://www.worlds.com/">Worlds.com's</a> securing the services of General Patent Corporation for the purposes of enforcement <a href="http://massively.joystiq.com/2008/12/12/patents-threaten-virtual-worlds-mmogs/">earlier this month</a>.</p>
<p>We can learn a few things from the suit against NCsoft, including (we think) how Worlds.com/General Patent sees its own position with respect to these claims (they don't seem to think it's as firm as it could be). You might also be wondering about prior art (which is abundant). Well prior art, in and of itself, is simply not enough. Not on its own.</p>

You might remember <a href="http://massively.joystiq.com/2008/12/12/patents-threaten-virtual-worlds-mmogs/">earlier in the month</a> we reported on <a href="http://www.worlds.com">Worlds.com</a> placing down patents on two technologies that we commonly use in the MMO industry -- <a href="http://www.google.com/patents?id=BYoGAAAAEBAJ&amp;dq=6,219,045">scalable chat</a> and system and method of enabling users of <a href="http://www.google.com/patents?id=wv5-AAAAEBAJ&amp;dq=7,181,690">interacting in a virtual space</a> -- and how much havoc this could play with our favorite games. We also made the assumption that lawyers were going to begin marching from Worlds.com with suits in hand, beginning their demands of money.<br /><br />It turns out <a href="http://www.virtualworldtimes.com/files/complaintworldscomvnesoft6-08cv508.pdf">our assumption was right</a>. Worlds.com has filed the necessary paper work to bring a suit against one of the big names in our industry: <a href="http://www.plaync.com">NCsoft</a>. The suit was filed on Christmas Eve, December 24th, and charged <a href="http://massively.joystiq.com/tag/ncsoft/">NCsoft</a> with infringement of patent 7,181,690, the system and method of enabling users of interacting in a virtual space, which was granted in early 2007. <p>There's a lot of slicing, dicing and hair splitting over nearly every part of that sentence, and some extraordinary debates and numerous calls for reform of the patent system. Nevertheless, today we're looking at two patents that the owners appear to be keen to enforce.</p>

University of Southern Queensland (Australia) has <a href="http://www.wipo.int/pctdb/en/wo.jsp?IA=WO2007098560&amp;wo=2007098560&amp;DISPLAY=STATUS">a patent in the pipe at the moment that covers the extraction and avatar expression of avatar emotions</a> -- at least if we're reading this right.</p>
<p>The idea is that the system is supposed to work out emotional content based on input text or voice, generate an overall emotion plot in a multidimensional coordinate system, and then express that emotion through your avatar. Essentially your avatar is animated and expressive according to your detected mood in order to communicate the non-verbal cues normally associated with that mood.</p>
<p>Will you see this in (say) <a href="http://secondlife.com/"><em>Second Life</em></a>, for example? Probably not. The <a href="http://secondlife.com/corporate/tos.php"><em>Second Life</em> Terms of Service</a> grant an "a non-exclusive, worldwide, fully paid-up, transferable, irrevocable, royalty-free and perpetual License, under any and all patent rights you may have" to Linden Lab and all <em>Second Life</em> users as a part of pushing content in or through the virtual world.</p>
