<br />
Yes, it appears to be true! <a href="http://massively.joystiq.com/tag/spacetime-studios/">Spacetime Studios</a> is working on a fourth title for its popular mobile MMO library, <a href="http://www.trademarkia.com/arcane-legends-85589926.html">filing a trademark</a> that has since been approved. The application for a U.S. federal trademark was submitted on April 5th and was given the thumbs up May 10th. As one of its categories is "electronic game software for cellular telephones," we can reasonably deduce that <em>Arcane Legends</em> will launch on mobile devices in the same manner of its older siblings.<br />
<br />
Spacetime Studios told us that it will release an official announcement of the title later this week. First there was <a href="http://massively.joystiq.com/tag/the-burning-crusade/"><em>The Burning Crusade</em></a>, then <em><a href="http://massively.joystiq.com/tag/wrath-of-the-lich-king/">Wrath of the Lich King</a></em>, and, most recently, <a href="http://massively.joystiq.com/tag/cataclysm/"><em>Cataclysm</em></a>. <a href="http://massively.joystiq.com/category/world-of-warcraft"><em>World of Warcraft's</em></a> expansions have been the lifeblood of literally millions of gamers' playtime, which is why many fans are anxiously awaiting word of the fourth expansion pack to the hit MMO.<br />
<br />
Today we may know the name of the expansion: <a href="http://massively.joystiq.com/tag/mists-of-pandaria/"><em>Mists of Pandaria</em></a>. According to MMO Champion, <a href="http://massively.joystiq.com/tag/blizzard/">Blizzard</a> filed a trademark with this title on July 28th, which is exactly in line with how the company has procured titles for the previous expansions. The trademark specifies that this is for "computer game software."<br />
<br />
The Pandarens are one of the more light-hearted races in the Warcraft franchise, with kung fu panda bears from a secret empire somewhere in Azeroth. Despite being fan favorites, the Pandarens have been rarely seen in <em>WoW</em>, while Blizzard has used them in a couple different April Fool's jokes in the past.<br />

The <a href="http://massively.joystiq.com/tag/harry-potter/">Harry Potter</a> fan base was abuzz yesterday as <a href="http://www.pottermore.com/">a mysterious new website</a> was launched. The site itself is rather bare, merely sporting the words "Pottermore: Coming Soon" and J.K. Rowling's signature underneath, but there's reason to believe that this may be connected to an online game.<br />
<br />
It gets interesting when you look at <a href="http://www.trademarkia.com/pottermore-77788415.html">Pottermore's trademark page</a>, which lists the trademark as being owned by <a href="http://massively.joystiq.com/tag/warner-bros/">Warner Bros. Entertainment Inc.</a> and describes the product as follows:

<a href="http://www.guardian.co.uk/books/2011/jun/16/harry-potter-jk-rowling-pottermore">The Guardian</a> notes that Pottermore could stand for "Potter Multiplayer Online Role-playing Experience," among other things. An editor at <a href="http://www.hpana.com/news.21283.html">HPANA</a> was one of the few to get a glimpse of the full site, commenting, <em>"It is breathtaking in scope, detail and sheer beauty."</em> Meanwhile, on <a href="http://www.youtube.com/JKRowlingAnnounces">YouTube's JKRowlingAnnounces channel</a>, a timer is counting down to an announcement as to why "the owls are gathering" sometime on the 23rd.<br />

Of course, <a href="http://massively.joystiq.com/2011/05/05/the-perfect-ten-why-a-harry-potter-mmo-makes-sense/">a Harry Potter MMO</a> has been <a href="http://massively.joystiq.com/2008/06/17/the-likelihood-of-a-matured-harry-potter-mmo/">heavily rumored</a> for some time now, perhaps in association with <a href="http://massively.joystiq.com/tag/turbine/">Turbine</a> (which is owned by WB). It's a tenuous connection but a possibility as well, so we'll be keeping our eyes on the site to see what transpires!<br />

<div style="text-align: left;">When it comes to free-to-play games, we don't often see the licensing companies buying titles outright. Normally, we're prone to seeing licensing agreements until a game has launched or when two companies have a history of working together quite a lot. Nonetheless, today <a href="http://massively.joystiq.com/tag/Gamigo/">gamigo</a> proved that it really believes in how much players are going to enjoy its upcoming space dogfighter, <em><a href="http://blackprophecy.gamigo.com">Black Prophecy</a></em>, by buying all rights and trademarks related to the game from Reakktor Media. <br />
<br />
The other interesting piece of news is that at the same time as the <a href="http://massively.joystiq.com/category/Black-Prophecy/"><em>Black Prophecy</em></a> acquisition, gamigo also opted to pick up nearly 20% of <a href="http://massively.joystiq.com/tag/Reakktor-Media/">Reakktor Media</a>. All remaining shares of Reakktor Media remain under the control of the company's CEO, Kirk Lenke, which effectively puts all development control moving forward between Reakktor and gamigo. <br />
<br />
If you really don't care about corporate merges and buyouts, then there's still a nugget of news to be gleaned for you. In amongst all the happy congratulations and notes about how this will make things better and easier for the two companies was a note that we should "<em>[look] forward to seeing Black Prophecy go live <strong>in the very near future</strong></em>." (Emphasis theirs.) <p>The last time we saw any statistical data on overall awareness of intellectual property issues, it seemed that awareness of copyright and trademarks was quite appallingly low - and actual <em>accurate</em> knowledge about them was a very rare thing indeed.</p>
<p>Surprisingly few people seem to know their way around the don't-do basics, and with record numbers of trademarks being registered in recent years, it is actually nice to see that some online operators have got a firm grip on things this year.</p>
<p>Honestly, if you tossed a press release on our collective desk touting your virtual environment or MMOG having items or outfits available in support of the <a href="http://www.fifa.com/">2010 FIFA World Cup South Africa[TM]</a> ... well, it'd probably cause an avalanche of pizza boxes ... but <em>after</em> we got the mess cleared, we'd probably assume that your promotional stuff was littered with unlicensed FIFA trademarks. Love them or loathe them they're in their third decade now, and like the Web, it's now more a matter of <em>how</em> they fit in to the rest of the world, rather than <em>if</em> they do.</p>
<p>In education, virtual environments are now a part of an educator's toolbox and as education continues to combine, refine, and recombine tools, virtual environments will find increasingly better, more effective uses in education. It's not that intellectual property infringement is  new - you can certainly replicate content with the official viewer  if you know  how - but it is in the limelight and a major feature of <a href="http://massively.joystiq.com/category/second-life"><em>Second Life</em></a>  discussions by virtue of assorted <a target="_blank" href="http://massively.joystiq.com/2009/10/27/second-life-designers-burned-at-burning-life/">high-profile infringements</a>, and <a target="_blank" href="http://massively.joystiq.com/2009/04/21/taser-international-vs-linden-lab-crack-den-crackdown/">legal</a> <a target="_blank" href="http://massively.joystiq.com/2009/09/16/eros-llc-shannon-grei-form-class-action-against-linden-lab-for/">actions</a>.</p>
<p>Copyright infringement can't be made to go away. Since the Statute of Anne in  1710 originally codified copyrights in law, infringement has only been somewhat  quelled by various means, never practically eliminated. <p>Numerous <a href="http://secondlife.com/"><em>Second Life</em></a> content creators are warning their clientele that the Web-site virtualget.net (which has been apparently been operating for a couple of months now) is a credit-card harvesting scam. Whether that's correct or not, the site appears to be using the product images and product descriptions and trademarks of numerous <a href="http://massively.joystiq.com/category/second-life"><em>Second Life</em></a> content creators without their permission. The original images and text appear on <a href="http://massively.com/tag/linden-lab">Linden Lab's</a> <em>Xstreet SL</em> virtual goods shopping Web-site.</p>
<p>Numerous DMCA notices are reportedly being filed by content creators at present. We attempted to contact virtualget.net (anonymously registered in Singapore) for comment, but none of their email addresses appeared to be functional -- One email address was restored to function when the majority of the site was taken down a short time ago, but we received no response. Linden Lab, who has an intellectual property stake in the matter, was not available for comment either.</p>
<p>Users of Kaspersky protection software found the Web-site marked as a phishing site several hours ago, presumably based on user reports.</p>
<p><strong>Update</strong>: The operation seems to have disabled access to much of the site in the wake of numerous DMCA notices filed by content-creators.<br /></p>

<p>When news broke about <a href="http://massively.joystiq.com/2009/10/01/linden-lab-punctures-education-community-with-newly-registered-t/">Linden Lab sending a takedown notice to the core <em>Second Life</em> education community Web-site</a>, our colleagues over at <a href="http://www.metaversejournal.com/">the Metaverse Journal</a> put a number of questions about the matter to Linden Lab.</p>

<p>Jokay Wollongong, one of the premier promoters and supporters of the educational uses of <a href="http://secondlife.com/"><em>Second Life</em></a>, and keeper of the largest single resource for Second Life educators, suffered something of a reversal this week, when <a href="http://massively.com/tag/linden-lab/">Linden Lab</a> decided that that very same resource, <a href="http://sleducation.wikispaces.com/">sleducation.wikispaces.com</a>, infringed on their <em>SL</em> trademark (which has now only been registered for nine days), and sent Wollongong a takedown notice.</p>
<p>That's something of a surprise considering Linden Lab's ongoing endorsement of the site on the Second <em>Life Education</em> mailing-list. A recent trademark filing from <a href="http://massively.joystiq.com/tag/ccp-games">CCP Games</a> for <em>DUST 514</em>, submitted by Atlanta-based attorney Steven M. Kushner, is described as providing 'entertainment services' and an 'on-line computer game'. <br /><br />If you look at the logo of a gas mask above a striped pattern, it bears more than a passing resemblance to the <a href="http://massively.joystiq.com/category/eve-online"><em>EVE Online</em></a> logo. The trademark filing description reads: <em>"The mark consists of a masked face with white sunken eyes and a round opening at the mouth. <p>One of the more curious things about the session is that no discussion of the definition of PG actually took place. Maybe the title of the session was just misleading, or we were just a bit optimistic. A large chunk of the discussion involved basics that have been rehashed over and over. It isn't often that we get  to cover the <em>end</em> of a lawsuit -- they generally tend to drag on  somewhat -- but it's possible that this might not be quite over.</p>
<p>Linden Lab hadn't yet filed a response to the original complaint, the suit  can be dropped 'without prejudice'. That means the suit can be filed again.</p>
<p>Perhaps Taser International has found some far more interesting or lucrative  basis for a case. It is also possible that the changes to <em></em><a href="http://secondlife.com/"><em>Second Life</em></a> products that now assert  the primacy of the TASER trademark have satisfied the company. Or perhaps, at  the end of the day, the whole effort met some unknown marketing targets. This  could all be on again. Watch this space.</p>

We got a hold of the April 17 complaint yesterday, and have been going through it since then. We've got a summary of the complaint and issues for you, but we won't be linking to the complaint due to the presence of what may be considered to be pornographic images in Exhibit 2. The "crack den" reference in the headline is a recurring phrase in the legal complaint. You'll see why.</p>

As it turns out, Victor Vezina is  Victor Keegan, <a href="http://www.guardian.co.uk/profile/victorkeegan">a  technology writer for the Guardian</a>.</p>
<p>Keegan started up an art gallery in in <em></em><a href="http://secondlife.com/"><em>Second Life</em></a> called 'SLart' in early  2007, prior to the establishment of Minsky's trademark -- however, legally it  matters less who is first and more who gets the blessing of the US Patent and  Trademarks Office (USPTO). Juris Amat, Minsky's legal representative wrote to  Linden Lab on Minsky's behalf instructing them to notify Vezina to cease and  desist from use of the SLART trademark in <em><a href="http://massively.joystiq.com/category/second-life"><em>Second  Life</em></a></em>.</p>

<p>As you may recall, <a href="http://massively.joystiq.com/tag/minsky-vs-linden-lab/">Linden Lab and Minsky  have been duking it out over trademarks</a>: Minsky with his registered  <em>SLART</em> trademark, and Linden Lab with its unregistered <em>SL</em>  trademark. Now, Linden Lab doesn't normally bother with getting court-approval  for terminating an account, yet they have asked for it in this instance.</p>

The United States Patent and Trademarks Office (USPTO) has dealt something of a blow to Linden Lab's background effort to <a href="http://massively.joystiq.com/2008/09/23/minsky-vs-linden-lab-restraining-orders-and-petitions/">convincing the USPTO that Minsky committed fraud</a> in registering the <em>SLART</em> trademark and that the <em>SLART</em> trademark should be cancelled.</p>
<p>In short, the Trademark Trial and Appeal Board (TTAB) has suspended cancellation proceedings for now, so the Lab won't make any further progress on that front for the time being. Minsky asked the TTAB for the suspension of proceedings, and the Lab argued against it -- but the Lab's argument apparently didn't hold up on basic reasoning.</p>
<p>We realize that the suspension of a cancellation proceeding generates a little confusion. Just bear with us, okay? One part is the cancellation process by which the USPTO determines if the <em>SLART </em>trademark should be cancelled. Whatever happens, there's no guarantee that it <span style="font-style: italic;">will</span> be cancelled, even if the process resumes. The process itself has been suspended however, based on the TTAB agreeing with Minsky's reasoning that the cancellation process should not proceed at this time. Suspension. Cancellation Process. Minsky previously filed a civil suit in a federal court, naming Linden Lab, Philip Rosedale, Mitch Kapor and one or more other <em>Second Life</em> users (as John Does) for (variously) trademark infringement, trademark dilution, tortious interference, and fraud.</p>
<p>Until such time as the judge decides whether a preliminary injunction should be granted, a temporary restraining order has been put in place -- most of the restraint being applied to Linden Lab. Meanwhile, Linden Lab has filed a petition of cancellation seeking to have the US Patent and Trademarks Office (USPTO) cancel Minsky's ownership of the <em>SLART</em> trademark.</p>

<p><a href="http://massively.joystiq.com/2008/09/03/minsky-vs-linden-lab-minskys-mark/">As we wrote previously</a>, the 'SL' trademark is not a registered trademark in the USA, and the registration process was started almost three months after Minsky commenced the process for his SLART trademark. Linden Lab's 'SL' trademark has now reached an interesting stage.</p>
<p>It has been published for opposition. Let's look at what that means ...<br /></p>

We previously wrote about his <a href="http://massively.joystiq.com/2008/01/19/slart-name-in-trademark-dispute/">assertion of his rights and obligations with respect to his SLART trademark</a>, which covers (among other things) Minsky's SLART magazine. The SL portion obviously represents <a href="http://secondlife.com/"><em>Second Life</em></a>, and the ART well... that's art.</p>
<p>Minsky originally filed his SLART trademark on 22 March, 2007. It was published for opposition on 18 September, 2007, and finally granted formal registration by the US Patent and Trademarks office on 18 March, 2008 (registration number 3399258). SLART, therefore, is owned by Minsky insofar as the US Government is concerned at the present time, whether that grant was conferred rightly or wrongly, unless it is somehow overturned or abandoned.</p>
<p>Now he has filed a civil suit in a federal court, naming Linden Lab, Philip Rosedale, Mitch Kapor and one or more other <em>Second Life</em> users (as John Does) for (variously) trademark infringement, trademark dilution, tortious interference (that is interference that causes injury), and fraud.</p>

<p>Linden Lab has been granted another trademark on their hand-and-eye logo. This time for a credit card. Specifically, trademark registration 3378449 covers "<em>Online financial services, namely, offering a fictional-dollar-denominated credit card to charge online purchases</em>".</p>
<p>Of course, 'fictional-dollar-denominated' would mean <a href="http://secondlife.com/"><em>Second Life</em></a> Linden Dollars (L$). Exactly what sort of card this might be is uncertain. You may recall that in 2006, <a href="http://news.bbc.co.uk/2/hi/technology/4953620.stm">MindArk released an ATM card for <em>Project Entropia</em></a> (now called <em><a href="http://www.entropiauniverse.com/">Entropia Universe</a></em>) allowing access to Project Entropia Dollars (PED) and supported by the Versatel cash-card network.</p>
<p>There's no indication whether Linden Lab is (or was) planning a physical card, or some sort of non-physical card, how it would be backed or where it might be honored.</p>

<p>Linden Lab has said on numerous occasions that they've been working on this for the last couple of years -- though there seems to have been little progress so far. Now, however, It looks like that's going to change. It appears Linden Lab is actually getting close to either a new client or service to improve instant-messaging.</p>

"<br /><br />That sounds awfully MMO-like, doesn't it? It's not even remotely conclusive though. Van Hemlock would like to talk about a <em><a href="http://massively.com/category/second-life/">certain virtual world</a></em>, but, alas, he cannot. It's not because he doesn't want to -- he does. Or because he thinks any less of ... this place, because he doesn't. It's just because he's careful. A certain entity has laid claim to some <a href="http://massively.joystiq.com/2008/03/25/linden-lab-asserts-control-of-names-and-images/">letters placed next to other letters</a>, and he's just respecting their rights. Van Hemlock isn't angry. He's just confused. <br /><br />Other games and virtual worlds have trademarks and yet manage not to <a href="http://massively.joystiq.com/2008/04/15/linden-lab-sparks-bloggers-strike/">anger their fan communities</a> .... Right or wrong? Minsky started SLART magazine in December 2006 "as a critical review and journal of the arts in Second Life".</p>
