I thought Massively had an article on this a few months back that Blizzard didn't care if Valve used the DOTA title or not.

I seem to remember that too, however, that certainly won't stop Kotick. Even if ActiBlizz has no case (although it's possible they may, I'm not to up on anacronyms) if he thinks he could get them to settle out of court to avoid a lengthy court battle, he would do it.

Well, I've never heard of someone being able to keep something legally open except for common names and words. DOTA I don't think would be common so I don't see how Blizz could stop Valve from trademarking it. If Blizz was smart, they would have trademarked it first and allowed public use of it if they didn't want anyone else to trademark it. That's about the only way they could do it.
