It's a troubling day for an already-troubled studio, as Cheyenne Mountain Entertainment has sold off Stargate Resistance -- the third-person shooter title that was made to help keep the company afloat and fund further development of Stargate Worlds -- to a startup company called Fresh Start. Fresh Start is comprised of former Cheyenne Mountain Entertainment employees, which means that the title is still in the hands of its makers.
Gamer/Law breaks down the recent events, and notes the salient details: that Fresh Start is in a joint venture agreement with CME to receive and run all of CME's assets (including Stargate Resistance), CME has the option to buy back these assets in the future, and there is no official word on Stargate Worlds. Gamer/Law speculates that there is either "some unpublicised arrangement has been entered into, or Cheyenne's Stargate MMO rights are an asset to be sold to satisfy creditors, or (possibly) Cheyenne has lost those rights following its entry into bankruptcy."
If you haven't been following the long, painful saga of CME and Stargate Worlds, suffice to say that this promising MMO suffered from lack of employee pay, devs jumping ship, extensive layoffs, lawsuits, Chapter 11 bankruptcy, a vague suit brought against former CEO Gary Whiting, and the sudden shift from developing SGW to getting Stargate Resistance out the door. However, whether this latest development will be a positive one to offer hope for a SGW resurrection or the death knell for the game has yet to be seen.

This is further proof that Stargate is not fiction, IT IS THE TRUTH !!! Now I'm 1005 convinced that Goa'ulds took over the board of "Cheyenne Mountain Entertainment" and they destroy themselves because of big egos instead of focusing on world domination. Bugger !!!

From memory its over $50 million in startup/development money Whiting has managed to fraudulently piss away in one way or another with nothing to show for it other than a hastily rushed out half arsed attempt at a FPS game with Stargate Artwork...something they only started cobbling together less than a year ago after they ran out of money for SGW and most Devs buggered off after not being paid for months.
Given Whitings track record of shady deals, pyramid schemes, siphoning money out of the company etc this latest scam is not surprising in the least.
SGW died about 2 and a bit years ago....Whiting is just dragging he corpse around Weekend at Bernies style to scam more cash out of suckers before the carcass falls apart.

From what it looks like to me, and this is my opinion, some of the CM guys needed a way to get money and no one would invest in CM. So they formed this outside company for the sole reason to be able to get loans and backing while not with the CM name. The option is there to buy back because they fully intend to just keep business as usual at CM.
To me it seems shady as hell. Shady business dealings is keeping with the whole upper management of this company. I would never deal with these guys, and I will never buy their products. They some how acquired a good license and now they're doing everything possible just to keep it from slipping from their hands. It will not end well for anyone.

The term is called Special Purpose Entity. This is the method that Enron was able to screw investors. It's still perfectly legal, mainly because if it was made illegal, various governments would be unable to provide the various functions they do now since the banking industry in every nation relies on this particular business relationship and is used to fund a significant portion of the social programs of all major nations.

Shady? depends on whether these are the good guys or the bad guys. It's possible that this is a way to get the assets away from any problems with CME's past investors and management. Essentially, a new indie studio is being formed with an IP that is still popular and running, and to me that opens up room for hope.
