This information isn't 100% true. Gary Whiting is no longer employed by CME or Firesky, this was told to me by Firesky member Tim Jenson. Gary is still saying he is CEO of CME when in fact he is not (why else would his name on CME's and Firesky's website be removed). Also on the Ch. 11 bankruptcy I can say this Ch. 11 was dismissed earlier this week because Gary requested it and when he did he was no longer a part of CME so it was invalid. Gary is tricking the court into thinking that he is still CEO of CME when he isn't.
" Mr. Whiting and his attorney continue to represent to everyone that he is still the chairman and CEO of CME and CMG. The court has not removed Whiting but the board of directors removed Whiting and Whiting is fighting that."

You may want to have another look at the court document I linked. It says very clearly that the court rejected the restraining order and the motion to remove Whiting.

If you have concrete proof via a later court order reversing this order, I'd love to see it.

Following oral argument, the Court received a Voluntary Petition filed by CME in the US
Bankruptcy Court on February 12, 2010 in case number 10-03632. By separate minute entry, the
Court will enter an automatic stay as to CME. Because the Court has no evidence that a petition
for bankruptcy has been filed as to CMG, the Court will proceed as to CMG only.

Pretty much says is it all and I wasn't accusing you of false info. Also take time out to contact CME or Firesky.

You do realize the part you cut and pasted proves without a doubt that CME filed for bankruptcy protection on the 12th, right? It says it right there in the first sentence.

It says they were granted an "automatic stay" which doesn't mean "the case was dismissed." An automatic stay stops creditors from coming after assets.

The third part just says that CMG (different company) didn't file for bankruptcy.

A lot of legal bull crap.... one thing for sure it does look like its time for Stargate Worlds to call it quits.... Does not help that SGU (new stargate series) did kill everything Stargate did stand for in the pass.

I came to this article to find out what changes the board requested from Cheyenne Mountain Entertainment that they refused to make. The Headline is "Cheyenne Mountain Entertainment refused requested board changes" but apparently this has nothing to do with this article or my reading comprehension is terrible because I can't find any mention of the CME Board of Directors in this post.

I feel really bad for all the employees who made phoenix their home for the work they did on the game.I was hoping this would bring more game companies to AZ. But it is time to let someone else take the license. I would love to see a Star Gate MMORPG with a sandbox element to it.

Krystalle Voecks can you please visit the CME and Firesky websites and read the board of directors and post them here, you will fin Gary Whitings name has being removed. Even this press release proves it http://www.firesky.com/pressrelease-2010-02-16.php with the title " Cheyenne Mountain Entertainment joins Litigation against Former Chairman, Gary Whiting."

Gary Whiting is not a member of the Board any more, also read the email I got it also backs that as well.

Okay, since you've decided to come back again, please note the date of your press release (2/16) versus the date of the court order stating that they can't remove him. (2/18, filed 2/19)

I tend to trust court documents as a good source for facts.

As before, if you have any more recent court documents indicating a change from the above, I'd love to see them.

Jason, you know as well as I do... Press Releases never lie.

Missed in all of this kerfuffle is that SGW is deader than Tabula Rasa. At this point, there is more news about which VC boneheads are fighting over the scraps of this IP than there is news about any actual game development occurring.

Wake me up when they announce a public beta or something.

It's a lot different when you are tossing out the CEO. CEO's are bound by a contract and typical "Work for hire" rules do not apply. If the judge found that the board violated the terms of his contract, then it is a breach of contract issue and they have every right to step in.

As long as he is CEO, he can file documents and act on the company's behalf even though he may have zero power within the company itself. (They don't have to let him in the building, or onto their network... but that can't stop him from filing a legal document on behalf of the company.) If the court has not decided the issue of whether or not he is CEO, then they cannot rule on subsequent legal issues until the first issue is resolved.

Yes you are correct when you said that the board frog marched Gary out. What this court case was about was Gary fighting his sacking and he's won a stay of execution - for the time being. So sacked yes, but now the court has thrown out the boards decision so technically the sacking has been thrown out legally, as of right now.

I'd assume, logically, that the time between his sacking and the court case that threw out the sacking is a legal 'grey' area and it was during this time that he filed for Bankruptcy protection. Because of the ambiguous nature as to his legal standing to do so its been shelved as well. I supposed technically, if he refiled right now it would go ahead.

Well, thats how I read it anyway.

I'm never getting my Stargate game am I? All the bullshit aside, i'm just not going to be able to play it right? I've been waiting for this game for idk how many years and the news gets darker and darker as time passes. I had hope when they announced they were going to release the Single Player game but I see that dying on the table too. To all the people who are behind me not being able to ever play this. Thanks for your tireless dedication to kill an IP that could have been so wonderful. Thank you for totally destroying this franchise and making it a big pissing match. Without you I might have enjoyed this game and had a lot of fun. Thank you for destroying all hope of this.
