They ban this way when people get reported for being underage. If I had to guess, this olmstead guy got into a chat scuffle with the person who copied his things, and TOLD him he would AR him. The thief then probably got PO-d and also filed a report.

Unfortunately they ban like this, even if they are false reports. I've seen it happen quite a few times :(

You'd think that much would be obvious when looking at the customer-service-records, and more care would be taken. Or maybe that's just my opinion.

I've seen as many underage reports pass without an identity check as those with.

I concur completely.

I make enough money in SL that SL pays for itself and I get to have some discretionary Linden cash.

I'd have to consider whether it's even with the cost in time and effort to file the DMCA paperwork to begin with. Thus - disgruntlement ensues. The grid population is massively (no pun intended, heheh) diluted as it is.

The next MMO that allows creators to create easily (no, NOT the Blue Mars way, but the SL way) - AND has a monetary system similar to Linden Lab's and makes a real, good faith effort at protecting I.P. - I suspect a massive exodus from the SL grid.

The only reason OpenSim isn't an option yet: no monetary system and no I.P. protection. Otherwise, people would leave SL in droves and bring their friends along with them.

Nobody else is ever going to do it the SL way because the problems that are at issue in this article and with the class action are symptomatic of the laissez faire system. A company may be able to ignore them when most people are dealing with pennies on the dollar. However, with real incomes comes real laws and real politics. Solutions need to be found and implemented simply as a measure of self-protection.

I suspect that Blue Mars have taken the steps they have because ultimately they'll be expected to act as a defacto adjudicator for any disputes and at least they'll know who uploaded the content and when. It won't solve the problem but it will at least ensure they can provide some level of due diligence should their adjudication be questioned by a real world legal authority. That may be the price that content creators must pay for having an IP dispute quickly resolved.

Being a neutral adjudicator is something that LL has been very reluctant to do. They prefer to have the legal fraternity deal with any issues. However, should LL lose this class action you may find they resort to similar measures as Blue Mars simply because it may mean they have little other choice but to deal with these issues themselves.
